General terms and conditions
1. Scope of application
The general terms and conditions (GTC) apply to all products ordered via the website www.woodsdog.ch. By sending an order, you expressly agree to these terms and conditions.
A customer is any natural person or legal entity that does business with WOODSDOG.
2. Conclusion of a contract
All information on goods and prices within the ordering process are non-binding. Sales contracts are concluded by acceptance of your order by WOODSDOG. The acceptance of the order will be confirmed by WOODSDOG via e-mail and is subsequently binding for you.
3. Information on this website
All texts and links have been carefully checked and are constantly updated. We strive to provide accurate and complete information on this website, but we do not assume any responsibility, guarantees or liability that the information provided through this website is accurate, complete or current.
Our prices do not include VAT. As a small business, we are exempt from VAT. Technical changes, errors and misprints are reserved, in particular WOODSDOG can make price changes at any time and without notice. For the calculation of prices, the time of the order on the website is valid.
5. Conclusion of contract
By placing an order via this website including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. WOODSDOG then sends an automatic “order confirmation” by e-mail, which confirms that the offer of the customer has been received by WOODSDOG.
If it turns out after the conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered completely, WOODSDOG is entitled to withdraw from the entire contract or from a part of the contract. If WOODSDOG has already received payment from the customer, the payment will be refunded to the customer. If payment has not yet been made, the customer will be released from the obligation to pay. WOODSDOG is not obligated to make a replacement delivery in the event of contract cancellation.
6. Payment terms and retention of title
Generally, the customer agrees to pay the amount by TWINT, credit card or by PayPal. WOODSDOG reserves the right to exclude customers from individual payment options without giving reasons.
We retain ownership of the goods until full payment of the purchase price.
7. Delivery | customs fees
All items offered by us are ready for shipment within 30 working days. The period for delivery begins after receipt of payment. If the deadline falls on a Sunday or on another holiday recognized by the state or customary at the place of performance, the next working day shall be deemed the day of performance.
If the carrier returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the cost of reshipment.
The shipping costs are charged additionally and shown separately in the order process. Shipping costs are calculated based on the current prices of the post office and any additional costs incurred in packaging.
The deliveries are sent by mail. The customer can choose between “registered mail” or “non-registered mail” in the order process. If the customer chooses delivery without registered mail, WOODSDOG cannot be held liable for lost deliveries. Likewise, in this case, the customer has no right to compensation.
The delivery will be sent to the address specified by the customer in the order. With the shipment, benefit and risk are transferred to the customer, to the extent permitted by law.
For deliveries abroad, customs duties may apply in the destination country. Woodsdog cannot influence customs duties and is legally obliged to indicate the correct value of goods/order value on the customs declaration. If customs fees are incurred, they are the responsibility of the customer. Please contact your local customs office for information.
8. Return | Exchange
In Switzerland there is basically no legal right of return.
Each product is checked by WOODSDOG before shipment and only after careful quality control, packed. The products delivered by us must be inspected upon receipt. Any defects must be reported immediately in writing, no later than 7 days after receipt. Otherwise, the delivery is considered accepted. If the complaint is justified and made in due time, a price reduction or replacement delivery will be made.
WOODSDOG bietet den Kunden die Möglichkeit, durch Grösse und individueller Farbgestaltung den Charakter ihrer Hunde in den Produkten widerzuspiegeln. Each product is handmade unique and therefore excluded from exchange.
For errors made by the customer when ordering (eg wrong size), we do not allow the right of return, because the products from WOODSDOG are individual and custom-made.
Reduced goods are excluded from exchange.
WOODSDOG undertakes towards the customer to provide the services carefully in accordance with these GTC. Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded against WOODSDOG, except in cases of willful misconduct or gross negligence, and against WOODSDOG’s vicarious agents. Liability for indirect damage and consequential damage resulting from use, from faulty performance or from loss of performance is excluded.
10. Modification of the terms and conditions
WOODSDOG reserves the right to modify these Terms and Conditions at any time and to put them into effect without notice.
Vouchers are excluded from exchange, no cash payment is possible. Any difference between the voucher value and already purchased products will not be refunded after redeeming the voucher.
Cash and discount vouchers cannot be accumulated.
WOODSDOG does not assume any liability for the customer’s misconduct in the care and or handling of the products.
